A credible agency will give a specific answer. A firm doing permanent placement must exist as a legal business and invoice correctly. A firm that deploys contract staff on its own payroll takes on statutory employer duties. A firm that sends candidates to jobs abroad needs a license from the Ministry of External Affairs. These are three different businesses, and a registration for one does not cover the others.
Match the Registration to Your Hiring Model
Permanent placement is the simplest case. The candidate joins your payroll, and the agency earns a fee. Your checks are basic: incorporation or partnership records, a GSTIN that shows as active on the GST portal, and invoices raised at 18% GST in the same legal name as the agreement. If the name on the contract differs from the name on the invoice, pause and ask why.
Contract staffing works differently. The professional sits in your office, but the agency is the employer on record. That agency must hold its own EPFO and ESIC codes and deposit contributions every month. Where it deploys 50 or more workers under a contract, it also needs a license under the Occupational Safety, Health and Working Conditions Code. Ask for challan copies as well as registration numbers. A registration proves that an account exists. A challan proves that money was paid into it.
When a Vendor Cuts Corners, the Bill Comes to You
Many Mumbai employers learn this too late. Under Indian labor law, the company where contract staff actually work is the principal employer. If the staffing vendor skips provident fund deposits or pays below statutory wages, the authorities can recover those dues from the principal employer. The principal employer is then left to recover the money from the vendor.
Now that the labor codes are in force, principal employers are expected to keep more documentation, not less. A cheap markup from a poorly registered vendor can end in an inspection notice, backdated contributions, and interest. Every contract staffing agreement should give you the right to audit the vendor's statutory payments, and you should review those payments every quarter.
The Maharashtra Layer That Outside Vendors Miss

Maharashtra deducts professional tax from salaries, and the Maharashtra Labour Welfare Fund collects contributions twice a year, in June and December. Sometimes a vendor from another state quotes a cost-to-company figure with neither line item. That means it has either overlooked them or intends to add them later, and both are poor signs. Ask for a sample salary breakup before you approve rates.
Hiring for Roles Abroad: One License Decides
The rules become much stricter when a Mumbai company recruits for an overseas subsidiary or when a foreign employer hires Indian professionals through a Mumbai agency. Under the Emigration Act, 1983, only recruiting agents registered with the Protector General of Emigrants may recruit Indian nationals for employment abroad. Registered agents are listed on the government's eMigrate portal, and the registration number should appear on the agency's letterhead and advertisements.
